A Legal Sociological Analysis of Cases of Non-Narcotic Substance Abuse in Whip Pink Circulating in Society in Indonesia

The phenomenon of substance abuse in Indonesia has undergone a paradigm shift with the emergence of New Psychoactive Substances (NPS) and the use of legal commodities for recreational purposes. This study aims to analyze the construction of sociological meanings of Whip Pink (Nitrous Oxide/ N2O ) and identify the obstacles of legal instruments in reaching its distribution. Through a sociological legal approach, it was found that there has been a shift in the objective meaning of N2O from a culinary aid to an instrument of "intoxication" normalized by urban culture. Legally, law enforcement is hampered by the principle of legality (nullum delictum) because this substance is not listed in the appendix to Law No. 35 of 2009 concerning Narcotics. The results of the study indicate that the legal vacuum and bureaucratic obstacles in the classification of new substances create gaps for the free circulation of dangerous psychoactive substances. This study recommends the need for regulatory flexibility in the 2026 National Criminal Code and the strengthening of the function of forensic laboratories to respond to the dynamics of NPS in real time
